Guarantees and Indemnities
At First American Flood Data Services we deliver a full spectrum of
services, from basic determinations through portfolio tracking. Free
from any conflict of interest, we provide objective results to ensure
lender compliance.
Each flood certification we issue carries the following complete
guarantee:
-
If we have issued a certification on a property stating that the insurable structure is not located within a Special Flood Hazard Area (SFHA), but was in fact discovered to be located in a SFHA per the
Federal Emergency Management Agency (FEMA) flood map effective as of the date of the certification, we will reimburse the client or client’s
borrower for the cost of any uninsured flood loss suffered by the client that would have been paid by an NFIP policy, less any premiums that would have been paid if an NFIP policy had been in effect.
-
Conversely, if we have issued a certification on a property stating
that the insurable structure is located within a SFHA, but was in fact
discovered to be not in a SFHA per the FEMA flood map effective as of
the date of the certification, we will reimburse the client or client’s
borrower for any excessive flood insurance premiums paid during the life of the loan.
Life-of-Loan and MapTrak clients receive the following additional guarantee:
Should the zone status of a property change as a result of the issuance
of a revised FEMA flood map, and we fail to notify you of the change, we will reimburse the client or client's borrower for the cost of any
uninsured flood loss suffered by the client that would have been paid by an NFIP policy (per guarantee above), or for non-mandatory flood
insurance premiums paid in the case of the removal of the property from
the SFHA (per guarantee above).
